Non-Permanent Activities Introduction The Intellectual Property Law (LPI) 22/1987, of the 11th November, establishes in section IV, article 140, that rights management societies have the obligation of performing activities designed to assist and promote the sector, and of allocating to these activities a percentage of their annual income. Furthermore, the Royal Decree 1434/1992, of the 27th November, in article 39, sets this percentage at 20% of the compensatory private copy royalties. Article 155, currently in force, of the Intellectual Property Law – Combined Text, approved by the Royal Legislative Decree 1/1996, of the 12th April, also contains this legal obligation. It is recognised by EGEDA in article 57 of its By-Laws. In compliance with the above, EGEDA dedicates a minimum of 20% of its revenues each year to assistance and promotional activities. The function of this department is to propose spending allocations for this fund for each year and to execute this allocation plan, once the proposal has been approved by the Board of Directors or the General Board, under the supervision of the General Manager of the organisation. With regard to the assistance fund, due to the difficulty experienced by EGEDA in providing certain social benefits or aid, as our members are not private individuals, the Ministry of Culture allows the activities of this fund to be oriented towards other initiatives benefiting EGEDA members, which could be described as social in a wider sense, such as: A. Anti-Piracy activities, also attendance of and participation in lawsuits where case law, of interest to the sector, may be established. B. The promotion of international relations and agreements. C. The establishment and maintenance of offices providing specialised legal, fiscal and technical advice, as well as library, phonographic library, databank and specialised documentation services. Regarding the audiovisual sector promotion fund, the main allocations are listed below, however it should be noted that some of the following activities can be classified both as assistance and promotional services. EGEDA (Seville Office) •FORCEM courses EGEDA requested and was granted aid from FORCEM, "The Institute of Continuous Training" (Instituto para la Formación Continua) which it has allocated to running a variety of courses, offered preferentially to the employees of companies associated to EGEDA and FAPAE, but also for those of other companies within the audiovisual sector. Training commenced in December 1998, and the course on "Audiovisual Production Management", given by Media Business School, was of particularly high quality.
In the year 2000 two further courses were held: "The pillars of teamwork" (20-21 October) and "First-aid" (13 December). In 2002 three courses were delivered: "Audiovisual production and cinematographic works", "The creation of high-productivity teams" and "Motivation and teamwork". In 2003 three new training programs subsidised by the "Tripartite Foundation for On-the-Job Training" (la Fundación Tripartita para la Formación en el Empleo) (formerly FORCEM). •Universidad Rey Juan Carlos [King Juan Carlos University] •Intellectual Property Course at ICADE This course is aimed at graduates with an interest in specialising in this area of the Law, not normally included in official syllabuses. It focuses on providing an understanding of the Spanish legal system with respect to intellectual property and comparing this with other international systems. The aim of the course is to go deep into essential knowledge of this specialty on a practical level, focusing on the most common juridical problems which arise in the main sectors which compose our information / knowledge-oriented society. The lecturing staff comprises expert professionals in this subject both with academic backgrounds and professional practitioners such as lawyers or legal advisors from organisations and institutions belonging to this sector. This is an audiovisual development program which benefits from a multilateral financing fund dedicated to promoting cinematographic activity, especially in the case of Latin American cinema or television co-productions. •Latin American Cinematographic Project Development Course This course, given by Gerardo Herrero, brings together the three fundamental pillars of cinematographic creation: scriptwriters, directors and producers, with the aim of improving the quality of audiovisual projects from their initial, embryonic phase, in order to produce quality scripts suitable to be made into films. By means of this initiative EGEDA aims, once again, to strengthen the solidity of cinematographic projects from the initial scriptwriting phase, and to be actively involved in the training of the young talented artists who represent the future of our industry. This course is designed for first-time Spanish and Latin-American scriptwriters, directors and producers. The Casa de América and the Carolina Foundation, in collaboration with EGEDA, the Ibermedia Program and the Ministry of Culture, opened the application period for places on the Fifth Latin American Cinematographic Project Development Course in 2006. The deadline for registration was in March. From the scripts chosen and developed in the first three years the course has been running, sixteen films have been produced and another ten are in various phases of pre-production. •Institut Català de les Industries Culturals – ICIC [Catalonian institute of cultural industries] The agreements were based on the promotion, marketing and internationalisation of the Catalan companies in the audiovisual industry in order to introduce local productions into international circuits and boost cultural audiovisual consumption. It was also decided to carry out measures to help provide services for independent producers, as well as promoting Catalonia as a filming location. •"The Latin American Audiovisual Co-production Forum" (Foro Iberoamericano de Coproducción Audiovisual), in which every year almost 100 Spanish / Latin American co-production projects participate. Four forums have been held to date: the first, at the Círculo de Bellas Artes in Madrid, from the 20th to the 22nd of June, 2000; and the second, third and fourth at the "Huelva Latin American Cinema Festival" (Festival Iberoamericano de Cine de Huelva). •"The Latin American Audiovisual Co-production Forum" (Foro Iberoamericano de Coproducción Audiovisual), in which every year almost 100 Spanish/Latin American co-production projects participate. Six forums have been held to date: the first, at the Círculo de Bellas Artes in Madrid, from the 20th to the 22nd of June, 2000; and the second, third, fourth, fifth and sixth at the "Huelva Latin American Film Festival" (Festival Iberoamericano de Cine de Huelva). •"Scriptwriting Agreement" (Convenio para la escritura de guiones) (ICAA) EGEDA participated with a donation of 250,000 euros per year to the script development fund for Spanish feature-length films or television series. The aid from the fund was spent on quality, competitive projects submitted by producer/scriptwriter teams, who had signed a contract together with the objective of making a film or television series. Under the latest Program (2003), help with writing fifteen scripts and various feature length television/cinema projects was awarded.

In-house Promotional Activities •"The José María Forqué Film Award" (Premio Cinematográfico José María Forqué) In 1996, EGEDA created the José María Forqué Film Award for Spanish cinema production, in honour of memory of one of the fundamental figures in Spanish cinema, founder and first president of EGEDA; also with the intention of raising awareness about the importance of film producers and the audiovisual industry in general. The prize is awarded to the best Spanish production of the previous year, elected by all the Spanish producers who are EGEDA members, by a two-stage secret ballot in the presence of a notary.
The José María Forqué Cinema Award includes prize money of 30,050 euros. On the occasion of the first award ceremony, in April 1996, the prize was given to the film "Nobody Will Speak of Us When We’re Dead" (Nadie hablará de nosotras cuando hayamos muerto), directed by Agustín Díaz Yanes and produced by Flamenco Films and Xaloc. On the second, held in April 1997, the award went to the feature-length film "Thesis" (Tesis), directed by Alejandro Amenábar and produced by Las Producciones del Escorpión. In April 1998, the third event was held, and the award-winning work was "Lucky Star" (La buena estrella), directed by Ricardo Franco and produced by Pedro Costa P.C. and Enrique Cerezo P.C. For the fourth ceremony, held in May 1999, an innovation was introduced in the form of a two-stage voting system: In the first, five finalists were chosen and, in the second, the winning film amongst these. The five films initially selected that year were: "The Grandfather" (El abuelo), "The Lovers of the Arctic Circle" (Los amantes del círculo Polar), "Barrio", "The Girl of Your Dreams" (La niña de tus ojos) and "Tango". The work chosen for the prize was "Barrio", directed by Fernando León de Aranoa and produced by Elías Querejeta P.C. and Sogetel. On the fifth year, the award ceremony took place in May 2000, and the finalists were: "Flowers from Another World" (Flores de otro mundo), "Goya in Bordeaux" (Goya en Burdeos), "Butterfly" (La lengua de las mariposas), "Alone" (Solas) y "All About My Mother" (Todo sobre mi madre). The prize was awarded to "Alone" (Solas), directed by Benito Zambrano and produced by Maestranza Films, S.L. The sixth ceremony took place in May 2001, and on this occasion the EGEDA members, in the first vote, chose 6 films as finalists (the fifth selection resulted in a draw): "Pellet" (El Bola), "Common Wealth" (La Comunidad), "The Back of the World" (La espalda del mundo), "Leo", "I Know Who You Are" (Sé quién eres) and "You’re the One". The second vote was in favour of "Pellet" (El Bola), directed by Achero Mañas and produced by Tesela Producciones. As usual, presiding over the ceremony and giving the prize was the Minister of Education, Culture and Sport, Pilar del Castillo. The awards ceremony this time received support and coverage from Televisión Española. The seventh event was held in April 2002. There were four finalists, as the first vote resulted in a multiple draw for fifth place and, in accordance with the Regulations of the Award, the films which tied were disqualified. Therefore, the finalists were: "En Construcción", "Son of the Bride" (El hijo de la novia), "Juana la Loca" and "The Others" (Los otros). In the second vote the film "En Construcción" was selected as the winner; this was directed by José Luis Guerín and produced by OVIDEO. The awards ceremony was held in the Royal Theatre, (Madrid) and presiding over it was the State Secretary of Culture, D. Luis Alberto de Cuenca. The prize was given by Marisa Paredes, President of the Academia de Cine. The event was sponsored by the ICAA and TVE, and also collaborating were Sony, Mercedes Benz, Mahou and Kodak. The eighth ceremony took place in May, 2003. There were five films in the list of finalists: "The Other Side of the Bed" (El otro lado de la cama), "The City of No Limits" (En la ciudad sin límites), "Talk to Her" (Hable con ella), "Story of a Kiss" (Historia de un beso) and "Mondays in the Sun" (Los lunes al sol). On this occasion the film "Mondays in the Sun" (Los lunes al sol) was victorious; produced by Elías Querejeta PC and Mediapro, this work was directed by Fernando León de Aranoa. For the first time, the award ceremony was held at the in Madrid’s Teatro Real ("Royal Theatre"), and presided over by the Minister of Education, Culture and Sport, Ms Pilar del Castillo, who presented the award. This event was sponsored by the ICAA, Televisión Española and the Madrid Council, and also received support from SONY, Mercedes Benz and Mahou. At the eighth José María Foqué award ceremony, for the first time, the EGEDA gold medal for an outstanding career was introduced. On this occasion in 2003 it was awarded to the producer, scriptwriter and director Pedro Masó. Similarly, another new prize was given: the Special EGEDA Award for the best feature-length documentary or Animated film. This prize was shared by "Cuban Rafters" (Balseros), by Bausan Films and El efecto Iguazú, by Cre-Acción Films. The ninth event was held in April 2004. The finalists were as follows: "Moscow Gold" (El oro de Moscú), "In the City" (En la ciudad), "My Life Without Me" (Mi vida sin mí), "Soldiers of Salamina" (Soldados de Salamina) and "Take My Eyes" (Te doy mis ojos). The prize-winning film was "Take My Eyes" (Te doy mis ojos), produced by Producciones La Iguana and Alta Producción, and directed by Icíar Bollaín. The evening ceremony took place in the Royal Theatre and was presided over by the Minister of Culture, Ms. Carmen Calvo. Verónica Forqué presented the award. This event was sponsored by Televisión Española, Fotofilm, Sony, Fujifilm, the ICAA, The Community of Madrid and Madrid Council, and was also supported by Mahou and Mercedes Benz. At the ceremony, the EGEDA gold medal 2004 was given to the producer Elías Querejeta. The second special EGEDA award for the best feature-length documentary or animated film was also awarded, and on this occasion won by the documentary "The Basque Ball: Skin Against the Stone" (La pelota vasca. La piel contra la piedra), by Alicia Produce, directed by Julio Medem. At the tenth ceremony in April 2005, the finalist films were "Héctor, Wolf” (El Lobo), "Bad Education" (La mala educación), "The Sea Inside" (Mar adentro) and "Tiovivo C. 1950", resulting in the award being given to "The Sea Inside" (Mar adentro), produced by Sogecine and Himenópetero, and directed by Alejandro Amenábar. Concha Velasco presented the award. The gala, held at the Teatro Real, was sponsored by TVE, Fotofilm, Sony, Fujifilm, the ICAA, the Region of Madrid and the City of Madrid, and was also supported by Mahou and Mercedes-Benz. It was presided over by the President of the Region of Madrid, Ms. Asperanza Aguirre. At this event, the EGEDA Gold Medal was given to the producer Luis Méndez, who had recently passed away. The third EGEDA Special Award for best feature-length documentary or animated film was given to "El milagro de Candeal", produced by Fernando Trueba (who also directed it), BMG and Iberautor. On 9th May 2006, the eleventh gala presentation of the José María Forqué Award was held in Madrid’s Teatro Real, presided over by the Minister of Culture, Carmen Calvo. Concha Velasco and Jorge Sanz hosted the evening and the music was provided by the group the Silver Tones, who performed rock and roll songs from the fifties and sixties; this was the first time in its history that the Teatro Real has staged this genre of music. La vida secreta de las palabras [The Secret Life of Words],by Isabel Coixet, produced by El Deseo and Mediapro won the eleventh José María Forqué prize, which was presented to the producers by the Minister of Culture. The runners-up were 7 Vírgenes [7 Virgins], Habana Blues, Obaba and Princesas [Princesses]. The 12th José María Forqué Award ceremony was held in Madrid’s Teatro Real on 8th May 2007. The event was honoroed by the presence of the President of the Region of Madrid, Esperanza Aguirre, and the Minister of Culture, Carman Calvo. Jaydy Mitchell and Juanjo Puigcorbé hosted the event, which included a performance by Fusion Dance. Directed by Juan Esterlich, Fusion Dance offered the public a combo act of some of the most cinematographic dance styles: tap-dance, break-dance and flamenco. El laberinto del fauno [Pan’s Labyrinth], by Guillermo Toro, produced by Estudios Picasso Fabrica de Ficción and Tequila Gang, won the award for best feature film which debuted in cinemas in 2006, as decided by EGEDA members with their votes. The other finalists were Alatriste, Azulnegrocasioscuro [DarkBlueAlmostBlack], and Volver [To Return]. At this year’s event, there were only four finalists because there was a tie for fifth place and, in accordance with the rules of the competition, only the first four were considered as finalists. For further information: EGEDA (Assistance and Promotional Fund) •Writing and distribution of the report "Audiovisual Panorama" (in Spanish) Every year, the Department of Distribution and Documentation (EGEDA), based on the information it receives about broadcasts on national, regional, digital and foreign channels, refines and studies these data and analyses the behaviour of the various television channels with regard to scheduling audiovisual works, in order to carry out royalties distribution.
Launched in 1996, to date various reports have been issued, containing information of great interest to producers about the policies followed by TV channels concerning the scheduling of audiovisual works. The circulation of these reports was restricted to EGEDA members, and to a few audiovisual sector institutions. Given the great interest this report aroused and despite its limited distribution at that time, only extracts being published in the national and regional press –El Mundo, ABC, El País, La Razón, Diario 16, La Vanguardia, El Faro de Vigo, Diario de Navarra, and others–, EGEDA decided to go one step further and publish the Audiovisual Panorama with increased circulation, with the support of the ICAA The edition Audiovisual Panorama 2001 included an initial tentative qualitative analysis as well as the usual quantitative studies –with regard to the year 2000– on film broadcasts, fiction series, documentaries and cartoons; on audience ratings, television consumption in Spain and throughout Europe, on the Spanish film market and on the broadcasting of Spanish audiovisual works on foreign channels. The next edition, Audiovisual Panorama 2002, took this type of analysis further, establishing comparisons between the new 2001 data and those of 1999 and 2000. Furthermore, it included a specific study "Special Dossier on TV movies" at the end of the report. In Audiovisual Panorama 2003, the qualitative analysis was more profound, making comparisons between the current and the previous three years, and adding chapters on the film market within international television, a panorama of tendencies in contents and advertising, and new technological developments in production and broadcasting of audiovisual material. The report ended with a "Special dossier on fiction series". Audiovisual Panorama 2004 followed along the same lines, broadening its analysis of local TV stations and digital channels, concluding with a Special Dossier on the production of animated films in Spain. Audiovisual Panorama 2005 continued and expanded on the presentation method an analysis of the 2004 edition, and ended with a Special Dossier on documentaries. Audiovisual Panorama 2005 contained some new features with respect to previous editions. One of these is the inclusion of six “opinion articles” written by well-known audiovisual industry professionals as introductions to some of the main chapters of the work. The special dossier used as a concluding piece each year was devoted to an analysis of the documentary in Spain, one of the genres becoming increasingly popular in our country. Audiovisual Panorama 2006 retains the traditional chapters on television audiences, films, fiction and cartoons on national television, Spanish cinema in international markets, the international television market, technological advances in the production and broadcasting of audiovisual content and audiovisual legislation in 2005 and the first quarter of 2006. It included six signed articles of qualitative analysis of television audiences, film markets, fiction, animation and documentary on national television, as well as a final commentary about the resulting conclusions. The special dossier discussed international Spanish co-productions 2002-2005. For further information: EGEDA (IT Department) •Information system for members about the broadcasts of Spanish feature-length films on foreign channels The EGEDA members receive this personalised information concerning over ninety foreign channels on a monthly basis. The system allows us to detect a large quantity of broadcasts on national and regional channels throughout Europe, the USA, Latin America and Oceania, which were formerly made without the knowledge or authorisation of Spanish producers, which happens quite frequently in the case of international co-productions.

For further information: EGEDA (Assistance and Promotional Fund) 5. EGEDA in the European Film Academy EGEDA joined the European Film Academy as a Patron Member three years ago. All the most important companies within the audiovisual sector are involved in the activities of this organisation.
This Academy was inaugurated a relatively short time ago, but its importance with regard to the promotion of European cinema is incalculable. The Academy’s European Film Awards, or Premios Cinematográficos Europeos, are still a new institution but enjoy great prestige, which increases with each year. EGEDA, in keeping with our view of the importance of the promotion of Spanish audiovisual productions, has offered sponsorship and support to the European Film Academy since it was founded. - "The Audiovisual Work: Creation, Production and Exploitation" (la obra audiovisual: creación, producción y explotación): 28th June to 1st July and 4th to 7th April 2006. •Film Production Workshop in Colombia - Held from 27th February to 3rd March 2006, the workshop included a seminar on theory and laboratory practice. The seminar, given to 100 professional producers, filmmakers and students offered three days of conferences and analysis on cases and debates, conducted by well-known American teachers and producers. Each and every phase of feature film production was dealt with, from project conception (including script-writing) to commercialisation of the final product, placing special emphasis on the US independent film production model.

•EGEDA sponsored the Annual Conference of the "Federation of Film Archives" (Federación de Archivos Fílmicos) (FIAF) held in Madrid from the 9th to the 18th of April 1999, organised by the Filmoteca Nacional de España and presided over by the guest of honour Martin Scorsese. The main objective of this Federation is the recovery and protection of world cinema heritage. •Since July 1996 EGEDA, together with the "One hundred years of Cinema Association" (Asociación Cien Años de Cine), has sponsored the creation of the NEGA database, work undertaken by the Filmoteca Nacional de España and consisting of the inspection, updating and classification of data corresponding to the negatives deposited in Spanish laboratories (Fotofilm Madrid, Fotofilm SAE, Madrid Film and Cinematiraje Riera), with the aim of standardising the terminology used in each, and comparing the information retrieved with that already to be found in the Filmoteca’s databases. The ultimate objective of this project is to obtain reliable data on the location and the utilisation of the original materials belonging to Spanish film heritage, and to establish their condition and possible future uses. •Festivals and Audio-visual Markets - "San Sebastián International Film Festival" (Festival Internacional de Cine de San Sebastián) •Sponsorship of the exhibition "1000 Images" at the 48th Festival (2000). - Los Angeles Latino International Film Festival (LALIFF) EEGEDA was one of the three main presenting sponsors at the 5th event, held from the 20th to the 29th July 2001. EGEDA attended this event again as a presenting sponsor on the occasion of the 6th festival, held from the 19th to the 28th July 2002. Once again, EGEDA was present at the 7th festival to be held, this time from the 18th July to the 2nd August 2003. EGEDA provided the same level of sponsorship at the 8th festival (16-25 July 2004). EGEDA again sponsored the 9th LALIFF festival (21st 30th October 2005), the 10th (5th to 15th October 2006) and the 11th (7th to 14th October 2007). - "Huelva Latin American Film Festival" (Festival de Cine Iberoamericano de Huelva) EGEDA contributed to the sponsorship of the 28thHuelva festival, which was held from the 9th to the 16th November 2002. The festival activities included, on the 11th, the presentation of the 1st Luis Buñuel award for the best Latin American film. The prize was awarded jointly by the FIPCA and EGEDA. EGEDA participated as a sponsor of this festival in 2003, 2004, 2005, 2006 and 2007. - Lanzarote Screenings EGEDA sponsored this event in 1999, 2000, 2001, 2002, 2003, 2004 and 2005. •Sponsorship of the 16th Festival and 8th International Short Film Market (2001). - MEDIMED. •EGEDA sponsored this market and presentation forum through APIMED "The Association of Southern Mediterranean Producers" (Asociación de Productores de Bajo Mediterráneo) in 2001, 2002 and 2003. - The Clermont-Ferrand International Short Film Festival (2002) •EGEDA sponsored a stand in this prestigious exhibition for Spanish producers attending the event. - Imagineindia 2006. •EGEDA participated in the organisation of the first Spanish Cinema Week in Delhi, India in February 2006. EGEDA’s sponsorship of this event covered 2006 and 2007. - Torrelodones. •Sponsorship of the "1st Film Exhibition" (la Primera Muestra Cinematográfica) (2001). - Support was given to the Cinemadrid Festival, held at the Kinépolis complex in October 2002. •Award Ceremonies and Other Events Concerning the Audio-visual Sector - "Cinema Writers’ Circle Awards" (Premios del Círculo de Escritores Cinematográficos) (CEC). •Sponsorship of the 57th Annual Awards Ceremony (2001). - Luis Buñuel Award for the Best Latin American Production (FIPCA) - SGAE-MPA-EGEDA Scriptwriters’ Tutorial: In 2004, the first SGAE-MPA-EGEDA Scriptwriters Tutorial was held, a course with the goal of perfecting works and opening doors professionally for them. •Sponsorship of the 16th annual award event of the Spanish Film Directors, held on the 26th October 2001.
