![]() Manager: Oscar Berrendo ▪Other Activities of the Distribution and Documentation Department Private Copy Royalty Distribution The possibility of making copies for private home use without the authorisation of the producer or that of other rights-holders made it necessary to establish a remuneration system to compensate the above for the financial losses arising from this unauthorised exploitation of audiovisual works. Once the sums corresponding to each business year have been collected, they have to be distributed amongst the rights-holders according to the use made of the repertoire, and in accordance with a system which excludes arbitrary allocation. The Distribution and Documentation Department’s function is to effect the distribution of the money received from the various royalties managed by the Association, principally from the private copy royalty and public performance. This activity is directly related to the entering the works in the data-base, modification and analysis of the various audiovisual works, which constitute the fundamental activity on which the correct distribution of the royalties is based. For this purpose, we work with companies which issue reports on the monthly diffusion or broadcasts of the works and recordings, with their respective audience ratings where applicable, and in ERATO. This is a database designed by EGEDA in which records are kept on the producers, audiovisual works and recordings (repertoire of the producers and other rights-holders, new film releases and a varied bibliography....). The daily updating of this database provides us with a reliable record of works and royalties ownership, which allows us to identify the broadcasts made over the year on the various private and public channels broadcasting throughout the year. Once the works and broadcasts have been identified, and at least once a year, the distribution of private copy royalties is carried out. This involves a particular sum being assigned to each broadcast for fair distribution among the rights-holders of the audiovisual works, in accordance with a non-arbitrary system and using distribution criteria approved by the General Board, which take the following parameters into consideration: SHOWING of the works on a television channel, earning royalties in favour of the copyright proprietor. The showing is analysed according to: •The coverage of each television channel: measured by the degree of penetration into the home (% of total homes). AUDIENCE. The percentages of average annual audiences for each channel are used and also the specific audience rating for each work, which is measured in audience points for every programme subject to payment of private copy royalties. RECORDING for private use, taking into account data on recording by channel, genre and time segment. Furthermore, regional disconnection carried out by television stations is also included in the distribution. Thanks to constant efforts and achievements attained through our daily work, EGEDA has become one of the rights management associations with the most accurate and rapid royalties distribution. Mention should be made of the collaborative contribution made by various television channels, especially in terms of identifying broadcasts. Currently we are working nation-wide with Televisión Española (TV1 and La2), Antena 3, Telecinco and Canal Plus, and on a regional level with Televisión de Galicia, Euskal Televista (ETB1 and ETB2), Televisión de Cataluña (TV3 and Canal 33), Canal 9, Punt 2, Telemadrid, Canal Sur, Canal 2 Andalucía, Ente Público Radio Televisión Canaria and Castilla La Mancha Televisión. Other Activities of the Distribution and Documentation Department In addition to the distribution of royalties due on private copies and public performance, plus keeping records of audiovisual works, the Distribution and Documentation Department also does other work, mainly focused on compiling and supplying information on a variety of subjects: • Broadcasting of Spanish films on foreign channels in the following countries: Argentina, Australia, Austria, Brazil, Belgium, Chile, Colombia, the Czech Republic, Denmark, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Japan, Mexico, the Netherlands, New Zealand, Norway, Peru, Poland, Portugal, Russia, South Africa, Switzerland, Sweden, the United Kingdom, the USA, and Venezuela.
